Can I sue my boss if I’ve been injured at work?

Your employer is obliged to make sure your workplace is safe. They also pay for WorkCover insurance which is there to cover your medical costs and other benefits if you do get hurt. Depending on the circumstances of the injury, you might also be able to sue for damages.

Tell us about the injury and we’ll be able to give you advice on what to do next no fee, no obligation.

Step 1 of 2

Sid was a labourer where part of his job was to unload scaffolding that returned to the warehouse.

One day he complained to his boss that his hand was hurting and he was having trouble lifting some of the scaffolding by himself. His boss said it was part of the job, and he’d better get used to it. As he tried to lift a steel pole from the truck he lost his grip, and the pole landed on his foot, shattering multiple bones. Sid would be off work for more than 12 months and was likely to have permanent damage to his foot.

In addition to a WorkCover claim for loss of income and medical expenses, Sid was also able to sue his employer for damages and received a big lump sum payout.

Lila loved her retail job, but she was always nervous when she was the only one on staff.

She told her boss many times that she was concerned about her safety, but they did nothing to improve the store’s security. As she was closing the shop one evening, she was held up by two men who threatened her with a knife before stealing goods and cash. Lila was deeply traumatised by the experience. She suffered nightmares and was unable to work in retail again. WorkCover covered her loss of income and medical expenses, but Lila also sued the owner of the business for negligence.
